Terms & Conditions

Boensch Travel LLC d/b/a Dream Destinations by Heather & Joe

1. Agency Identification & Acceptance of Terms

Boensch Travel LLC, a Michigan limited liability company, doing business as Dream Destinations by Heather & Joe (“Agency,” “we,” “us,” or “our”), acts as an independent travel advisor affiliated with a host agency.

By engaging our services, submitting payment, or otherwise authorizing travel arrangements, you (“Client,” “Traveler,” or “you”) acknowledge that you have read, understand, and agree to be bound by these Terms & Conditions.

2. Agency Relationship and Scope of Services

The Agency acts solely as an intermediary between the Client and third-party travel suppliers, including but not limited to airlines, cruise lines, hotels, tour operators, and transportation providers (“Suppliers”).

The Agency does not own, manage, or control any Supplier and shall not be liable for any acts, omissions, errors, delays, or failures of any Supplier.

3. Pricing, Availability, and Reservations

All quoted prices are subject to change without notice until confirmed by deposit or full payment.

The Agency does not guarantee:

  • Pricing accuracy prior to booking 
  • Availability of accommodations or services 
  • Supplier promotions or inclusions 

Travel pricing is dynamic and may fluctuate based on demand and Supplier policies.

4. Payment Authorization and Responsibility

By providing payment information, the Client represents and warrants that they are an authorized user of the payment method provided and authorize the Agency to process payment for agreed-upon services.

The Client agrees:

  • To provide accurate billing information 
  • To be financially responsible for all authorized transactions 
  • That all payments are subject to Supplier terms and conditions

5. Chargebacks, Payment Disputes, and Financial Liability

The Client agrees not to initiate any chargeback, dispute, or payment reversal for services that have been authorized and processed.

In the event of a concern, the Client agrees to contact the Agency first and allow a reasonable opportunity for resolution.

Unauthorized disputes shall constitute a material breach of these Terms. The Client agrees to reimburse the Agency for all resulting costs, including:

  • Chargeback and processing fees 
  • Administrative expenses 
  • Collection costs 
  • Reasonable legal fees, where applicable

6. Travel Insurance Recommendation and Assumption of Risk

The Agency strongly recommends the purchase of comprehensive travel insurance.

If the Client declines coverage, the Client acknowledges:

  • Full financial responsibility for any losses 
  • Potential forfeiture of travel costs 
  • That the Agency is not liable for unrecovered expenses 

7. Cancellations, Changes, and Refunds

All cancellations, modifications, and refund requests are subject to the terms, conditions, and policies of the applicable Supplier.

The Client acknowledges that:

  • Cancellation penalties and change fees may apply 
  • Certain travel arrangements may be non-refundable and non-transferable 
  • Refund timelines are controlled by the Supplier, not the Agency 

The Agency shall not be responsible for Supplier-imposed penalties or delays in processing refunds.

8. Professional Fees and Services

The Agency may charge professional planning and service fees, which are separate from Supplier costs.

These may include:

  • Research and trip planning 
  • Air booking services 
  • Changes or cancellations 
  • Post-booking assistance 

All fees are:

  • Non-refundable 
  • Earned upon performance of services 
  • Applicable regardless of booking outcome

9. Travel Documentation and Entry Requirements

The Client is solely responsible for ensuring compliance with all travel documentation requirements, including but not limited to:

  • Valid passports (recommended to be valid for at least six (6) months beyond travel dates) 
  • Visas 
  • Vaccinations 
  • Government-issued identification 

All traveler names must match government-issued identification exactly.

The Agency shall not be responsible for denied boarding, entry, or additional costs resulting from incomplete or incorrect documentation.

10. Limitation of Liability

To the fullest extent permitted by applicable law, the Agency shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from or related to:

  • Acts or omissions of Suppliers 
  • Travel delays or interruptions 
  • Personal injury, illness, or death 
  • Loss or damage to property 
  • Force majeure events

11. Force Majeure

The Agency shall not be liable for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to:

  • Natural disasters 
  • Acts of God 
  • Government actions or restrictions 
  • Pandemics or public health emergencies 
  • Labor disputes or strikes

12. Fraud Prevention and Verification

To protect against fraudulent activity, the Agency reserves the right to:

  • Request additional identification or documentation for payment verification 
  • Refuse or cancel bookings suspected of fraud or unauthorized use 
  • Report suspected fraudulent activity to appropriate authorities 

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Saginaw County, Michigan.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

15. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Client and the Agency with respect to the services provided and supersede all prior or contemporaneous communications, whether written or oral. 

By submitting payment, you confirm that you have read and agree to these Terms & Conditions.
