Your Travel Agreement

Boensch Travel LLC, a Michigan limited liability company, doing business as Dream Destinations by Heather & Joe ("Agency," "we," "us," or "our"), provides travel planning and advisory services to clients seeking vacation, cruise, resort, air, hotel, tour, transportation, excursion, travel insurance, and other travel-related arrangements.
The Agency operates as an independent travel advisor business affiliated with a host agency for access to certain supplier relationships, booking platforms, credentials, and industry resources. The Agency is independently responsible for the travel planning and advisory services it provides to Clients. Travel products and services are ultimately provided by third-party Suppliers, and Supplier terms and conditions apply.
By using our website, requesting travel planning services, submitting a trip inquiry, approving a quote or proposal, signing or electronically acknowledging a travel agreement, authorizing payment, or allowing us to make travel arrangements on your behalf, you ("Client," "Traveler," or "you") acknowledge that you have read, understand, and agree to these Terms & Conditions.
If you are making arrangements on behalf of other travelers, you represent that you have the authority to accept these Terms & Conditions on their behalf and are responsible for ensuring that all travelers in your party understand and comply with these terms.
Electronic acceptance, checkbox acknowledgment, email approval, text message approval, proposal approval, signed form, payment authorization, or other written or electronic confirmation may be used to confirm acceptance of these Terms.
The Agency acts as an intermediary between the Client and third-party travel suppliers, including but not limited to airlines, cruise lines, hotels, resorts, tour operators, excursion providers, transportation companies, travel insurance providers, and other travel-related companies ("Suppliers").
The Agency does not own, manage, operate, or control any Supplier. Supplier services are provided by the applicable Supplier and are subject to that Supplier's own terms, conditions, policies, availability, and restrictions.
Our role is to assist with travel research, planning, quoting, booking support, communication, and related travel advisory services. We use reasonable efforts to provide accurate information and helpful guidance; however, final pricing, availability, confirmations, schedules, policies, and travel services are controlled by the applicable Suppliers.
All travel products and services are subject to the terms and conditions of the applicable Supplier. Supplier terms may include, but are not limited to:
By authorizing the Agency to book travel, the Client agrees to be bound by the applicable Supplier's terms and conditions.
The Client understands that Supplier terms may be more restrictive than the Agency's policies and may change without notice. The Agency is not responsible for a Supplier's decision to change, deny, cancel, delay, refund, or modify any travel product or service.
All quoted prices are subject to change without notice until confirmed by the applicable Supplier and secured by deposit or full payment.
Travel pricing is dynamic and may fluctuate based on availability, demand, promotions, currency changes, fuel costs, taxes, fees, and Supplier policies.
The Agency does not guarantee:
A quote, proposal, itinerary, or pricing estimate is not a confirmed booking. Travel arrangements should not be considered final until confirmed by the applicable Supplier and any required deposit or payment has been successfully processed.
The Client is responsible for carefully reviewing all quotes, proposals, invoices, confirmations, itineraries, payment schedules, cancellation terms, Supplier terms, and travel documents.
The Client must notify the Agency immediately of any errors, omissions, misspellings, incorrect traveler information, incorrect dates, incorrect destinations, incorrect airports, incorrect cabins or rooms, or any other concerns.
Failure to promptly review and report errors may result in additional costs, penalties, denied boarding, denied entry, cancellation, or loss of travel arrangements. The Agency is not responsible for costs or penalties resulting from inaccurate, incomplete, or late-provided information.
By providing payment information, the Client represents and warrants that they are an authorized user of the payment method provided and authorize the Agency and/or applicable Supplier to process payment for agreed-upon services and travel arrangements.
The Client agrees:
Some payments may be processed directly by Suppliers, host agency systems, payment processors, booking platforms, or other third-party systems. The Agency is not responsible for delays, errors, declines, processing issues, or security practices of third-party payment systems.
Payment is not considered complete until successfully processed and confirmed by the applicable Supplier, payment processor, or booking system.
If you have a concern about a charge, payment, booking, cancellation, refund, or Supplier issue, you agree to contact the Agency first so we have a reasonable opportunity to review the matter and assist with resolution.
The Client agrees not to initiate a chargeback, payment dispute, or payment reversal for charges that were authorized, accurately processed, and related to services or travel arrangements requested by the Client, except where permitted by applicable law.
Filing a chargeback or payment dispute does not change or cancel the Supplier's terms, cancellation penalties, refund rules, travel credit policies, payment deadlines, or the Agency's professional service fees.
If a chargeback or payment dispute is determined to be improper, unauthorized, or inconsistent with these Terms, the Client may be responsible for resulting costs incurred by the Agency, including chargeback fees, processing fees, administrative costs, collection costs, and reasonable legal fees where permitted by law.
The Agency may charge professional planning, consultation, booking, change, cancellation, or post-booking service fees when applicable. These fees are separate from the cost of travel charged by Suppliers and are compensation for our professional time, research, planning, coordination, and support.
Any applicable professional fee will be disclosed to the Client before the fee is charged. Fees may vary depending on the complexity of the trip, type of service requested, and amount of planning or support required.
Professional fees, when applicable, are non-refundable once work has begun, including but not limited to consultation, research, quote preparation, itinerary planning, supplier communication, booking support, or post-booking assistance. These fees compensate the Agency for services performed and are separate from any Supplier payments, deposits, penalties, or refund policies.
Payment of a professional fee does not guarantee availability, pricing, approval of travel documents, Supplier acceptance, or a specific booking outcome.

Exact fees will be quoted before being charged and may vary based on the scope of services requested.
Professional planning and service fees may be waived, reduced, or adjusted at the sole discretion of Dream Destinations by Heather & Joe / Boensch Travel LLC. This may include, but is not limited to, returning clients, repeat bookings, simple supplier-direct bookings, group bookings, promotional offers, or other circumstances where a reduced fee is appropriate.
Any waiver or reduction of a professional fee does not guarantee that fees will be waived or reduced for future travel planning services. All fees, when applicable, will be disclosed before professional research, planning, booking assistance, or service work begins.
All cancellations, modifications, and refund requests are subject to the terms, conditions, and policies of the applicable Supplier.
The Client acknowledges that:
The Agency is not responsible for Supplier-imposed penalties, denied refund requests, delayed refunds, expired travel credits, or Supplier processing timelines.
While the Agency does not control Supplier cancellation penalties, refund eligibility, credit policies, or processing timelines, we will make reasonable efforts to assist the Client with communicating with Suppliers, submitting cancellation or change requests, requesting available refunds or travel credits, and helping the Client understand the Supplier's applicable policies.
The Agency cannot guarantee any refund, credit, reimbursement, schedule change, price adjustment, or exception unless confirmed in writing by the applicable Supplier.
Agency professional fees, when applicable, are separate from Supplier payments and are not automatically refundable if a trip is cancelled, changed, denied, delayed, interrupted, or otherwise not completed.
The Agency strongly recommends the purchase of comprehensive travel insurance to help protect against unexpected events, including but not limited to cancellation, interruption, medical emergencies, travel delays, lost or delayed baggage, supplier default, illness, injury, weather events, and other covered risks.
If the Client declines travel insurance, the Client acknowledges and accepts:
Travel insurance coverage, benefits, exclusions, and claims decisions are determined solely by the insurance provider. The Agency cannot guarantee coverage, claim approval, reimbursement, or specific policy outcomes.
The Client is solely responsible for ensuring compliance with all travel documentation and entry requirements, including but not limited to:
Passports are generally recommended to be valid for at least six months beyond travel dates, though requirements vary by destination, cruise line, airline, and government authority.
All traveler names must match government-issued identification exactly.
The Client is responsible for providing complete and accurate traveler information before booking, including full legal names exactly as shown on government-issued identification, dates of birth, gender markers where required by Suppliers or government authorities, citizenship, passport information, known traveler numbers, contact information, and any other details required for travel.
The Client is responsible for reviewing all quotes, invoices, confirmations, itineraries, and travel documents promptly and notifying the Agency immediately of any errors.
The Agency is not responsible for denied boarding, denied entry, delays, cancellations, rebooking expenses, additional costs, or forfeited travel arrangements resulting from inaccurate, incomplete, expired, missing, or late-provided traveler information or documentation.
Travel involves inherent risks, including but not limited to illness, injury, crime, weather events, political unrest, government restrictions, transportation disruptions, public health emergencies, and changing destination conditions.
The Client is responsible for reviewing current travel advisories, health requirements, safety information, and destination-specific rules before and during travel.
The Agency may provide general information or links as a courtesy, but the Client remains responsible for making informed travel decisions and complying with all applicable laws, regulations, and requirements.
The Agency is not responsible for destination conditions, government actions, travel advisories, entry restrictions, health requirements, crime, weather, or other circumstances outside of the Agency's control.
To protect against fraudulent activity, unauthorized transactions, and identity misuse, the Agency reserves the right to:
The Agency is not responsible for delays or cancellation of travel arrangements resulting from the Client's failure to provide requested verification in a timely manner.
To the fullest extent permitted by applicable law, the Agency is not responsible for any direct, indirect, incidental, consequential, special, punitive, or other damages arising from or related to:
Nothing in these Terms is intended to limit any rights that may not legally be limited under applicable law.
The Agency is not responsible for any failure or delay in performance resulting from circumstances beyond its reasonable control, including but not limited to:
In such situations, Supplier terms and policies will determine available remedies, if any.
The Agency may collect personal information necessary to provide travel planning and booking services, including names, dates of birth, contact information, passport or identification details, travel preferences, payment-related information, and other details required by Suppliers.
Client information may be shared with Suppliers, booking platforms, host agency resources, payment processors, insurance providers, or other travel-related service providers as necessary to research, quote, book, manage, or support travel arrangements.
Additional details about how personal information is collected, used, stored, and shared are provided in our separate Privacy Policy, which is available on our website.
By providing personal information to the Agency, the Client authorizes the Agency to use and share that information as reasonably necessary to provide travel-related services and acknowledges that they have access to the Agency's Privacy Policy.

The Agency makes reasonable efforts to keep website information accurate and current but does not guarantee that all pricing, offers, promotions, inclusions, fees, availability, or Supplier information displayed on the website will be current, complete, or error-free.
Supplier promotions, pricing, and availability are subject to change until confirmed by the applicable Supplier and secured by payment.
Website content, blog posts, destination information, travel tips, pricing examples, and promotional materials are provided for general guidance only and should not be considered a guarantee of availability, safety, pricing, entry requirements, or Supplier terms.
The Client is responsible for notifying the Agency of any accessibility needs, mobility limitations, medical conditions, dietary needs, bedding requests, room location preferences, seating requests, or other special requests before booking.
The Agency will make reasonable efforts to communicate special requests to Suppliers when applicable. However, special requests are not guaranteed unless confirmed in writing by the Supplier.
The Agency is not responsible for a Supplier's failure to accommodate special requests or accessibility needs.
The Agency may communicate with the Client by email, phone, text message, online forms, proposal systems, booking platforms, or other electronic methods.
The Client is responsible for providing accurate contact information and monitoring communications related to quotes, approvals, payments, deadlines, documents, schedule changes, and travel updates.
The Agency is not responsible for missed deadlines, missed communications, penalties, cancellations, or loss of travel arrangements resulting from incorrect contact information, failure to monitor communications, email filtering, spam folders, phone issues, or delayed responses from the Client.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan.
Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Saginaw County, Michigan, unless otherwise required by applicable law.
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms and Conditions constitute the entire agreement between the Client and the Agency with respect to the services provided and supersede all prior or contemporaneous communications, whether written or oral, regarding the same subject matter.
Additional Supplier terms, invoices, authorization forms, planning fee acknowledgments, proposals, and travel documents may also apply to specific bookings or services.
